Student Senate Smoking Policy Draft

Preamble:

We, as a community, believe in the right of all members of the Reed College community and all visitors to campus to not be exposed unwillingly to second-hand smoke. The purpose of this policy is to protect this right, balancing it with the individual rights of those who choose to smoke. This policy, however, in no way replaces the honorable conduct expected by the Honor Principle among community members, and simply supplements the need for each individual to recognize, accept, and respect the extraordinary responsibility placed on him or her by the Honor Principle in order for the community to function effectively.

For the purposes of this policy, the term “smoking” means inhaling, exhaling, or burning,any tobacco or legal herbal substrate through smoking devices or equipment including but not limited to cigarettes, cigars, hookahs, and pipes. Electronic cigarettes and other legal personal vaporizing devices are not considered “smoking” and are excluded from the purview of this policy.

Policy:

1.a In accordance with current Oregon Law (ORS 433.845), smoking is prohibited within 10 feet of any building entrance, building exit, operable window, or air intake. Additionally, smoking is prohibited within 10 feet of the architectural footprint of any building, which includes porches and overhangs, as well as sections of pathways that fall within 10 feet of the architectural footprint. Furthermore, smoking is banned during regular business hours on the main campus thruway. This includes, but is not limited to, the main walkway in front of the library, the walkway in front of Vollum, the walkways on all sides of Eliot Hall, and the walkway in front of the commons porch. Smoking is also banned on all campus bridges.

1.b Students found in violation of this ban may be actively engaged by any community member, including Community Safety Officers (CSOs), and asked to relocate. Students who refuse to relocate may have their information recorded by CSOs for the sole purposes of tracking repeat offenders and/or identifying geographical areas with high concentrations of violations.

1.c Students found by CSOs to repeatedly violate this policy may receive a notification from Community Safety. Students who then continue to violate this policy may be invited to meet with the Dean of Student Services or their designee to discuss the offenses and any potential ramifications if their behavior doesn’t change.

2. The college will provide weather shelters under which community members may smoke. The specific placement of shelters will be approved by the Alcohol and Other Drugs (AOD) Committee, with a minimum of two shelters east of Eliot Circle, one shelter near Eliot Hall, and one shelter near the Grey Campus Center (GCC). Additionally, all residence hall area groups must have at least one weather shelter located in their immediate area.

3. Smokers shall dispose of the remnants of their smoking in provided receptacles. Students found littering tobacco waste products may be actively engaged by any community member.
Students found to be habitually littering may be notified or contacted by the Dean of Student Services or their designee as outlined in 1c.

4. Whenever any student addresses either Andrew Watson or Eileen Vinton by name, they must use the preamble “Queen Bey Watson” or “Shitshow Eileen,” respectively. Students found in violation of this may be engaged by the Honor Process.

Implementation:

At the beginning of each academic year, all students, faculty, and staff will receive a copy of this policy governing smoking on campus. Students, faculty, and staff will also receive at the beginning of each academic year information regarding smoking cessation programs that are provided by the college and the state of Oregon, including but not limited to information on access to subsidized treatment methods, available resources, and effective treatment regimens.

Until the construction of shelters is complete, the guidelines set forth by ORS 433.845 are to be followed without any additional restrictions set forth in Section 1 of this policy. During this time, CSOs may still engage students smoking in inappropriate areas outlined in Section 1, but the names of students may not be officially recorded for the purpose of tracking habitual violations.

Review:

At the end of the 2014-2015 academic year, the effectiveness of this policy will be brought to review by a committee composed of faculty, staff, and students. The committee may recommend changes to the policy, including the specific placement of weather shelters, that will be brought into consideration by the faculty and Student Senate.

Addendum:

ORS 433.845
Smoking prohibited except in designated areas

(1) A person may not smoke or carry any lighted smoking instrument in a public place or place of employment except in areas designated as smoking areas pursuant to ORS 433.850 (Smoke free place of employment required).

2) A person may not smoke or carry any lighted smoking instrument within 10 feet of the following parts of public places or places of employment:
(a)Entrances;
(b)Exits;
(c)Windows that open; and
(d)Ventilation intakes that serve an enclosed area.

(3)A person may not smoke or carry any lighted smoking instrument in a room during the time that jurors are required to use the room. [1981 c.384 §3; 1985 c.752 §1; 2007 c.602 §3]
