Updated Community Affairs Smoking Policy Draft

Preamble

We, as a community, believe in the right of all members of the Reed College community and all visitors to campus to be able to conduct their affairs without unwillingly being exposed to second­hand smoke. The purpose of this policy is to express the need to protect this right while recognizing the individual freedom of those who choose to smoke. This policy does not replace the Honor Principle; it articulates a community norm that requires each individual to recognize a certain right and to act accordingly.

For purposes of this policy, the term “smoking” means inhaling, exhaling, burning, carrying or possessing any lighted tobacco product, or marijuana, or the use of smoking devices or equipment that includes, but is not limited to cigarettes, cigars, hookahs, and pipes.

Main Policy

1. Smoking is prohibited within 15 feet of the architectural footprint of all campus buildings. For the purposes of this policy, all entrances, exits, operable windows, air intakes, porches and overhangs of a building are included in its footprint.

2. Smoking is prohibited on all campus bridges.

3. Smoking is prohibited on all campus walkways, paths, and roads between the hours of 7:00 am and 7:00 pm.

4. Smokers shall dispose of the remnants of their smoking in appropriate receptacles.

5. Violations of this policy by students are grounds for initiation of the Honor Process, including informal and formal mediation. Egregious or repeated violations of this policy on the part of students will likely result in an Honor case. Violations of this policy by staff or faculty are grounds for initiation of appropriate grievance processes.

While all members of the community have the right to engage any person observed to be in violation of this policy, or to be smoking in another manner that exposes, or foreseeably might expose, others to unwanted second­hand smoke, the obligation to adhere to the policy rests upon the person smoking, regardless of whether anyone requests that they move or dispose of the remnants of their smoking appropriately.

6. In its restrictions on smoking, this policy may exceed, but will in no way negate, any aspect of the relevant local, state or federal smoking laws.

Shelters

The college will provide weather shelters for smoking that will be placed in areas in which community members may smoke without causing unwanted second­hand exposure to smoking byproducts. The Alcohol and Other Drugs (AOD) Committee will recommend, to the President of the College, the specific placement of shelters. For the purposes of this policy, these shelters will not be regarded as among the “buildings” addressed by clause 1 above. The President is responsible for declaring when the policy goes into effect, but at least two shelters must have been built before the effective date.

Dissemination of this policy

At the beginning of each academic year, all students, faculty, and staff will receive a copy of this policy governing smoking on campus. Students, faculty, and staff will also receive at the beginning of each academic year information regarding smoking cessation programs that are provided by the college and the state of Oregon, including but not limited to information on access to subsidized treatment methods, available resources, and effective treatment regimens.

Review and contingency policy

In the second half of the Spring semester of the 2014­2015 academic year, an ad hoc committee of 2 faculty (including one member of CAC), 2 students (including one senator), and 2 staff (one of whom will be the Vice President and Dean of Students) will evaluate the effectiveness of the above policy. The Dean of Students will serve as a non­voting chair of the ad hoc committee. The committee will perform its evaluation by means that may include (but are not limited to) the number of reported violations of the policy after the shelters are in place, and surveys of the student body, faculty, and staff. If the ad hoc committee reports to the community that the policy has been ineffective in preventing members of the community from being exposed to second­hand smoke, the contingency policy below will go into effect two weeks before the first day of classes in Fall 2015. The ad hoc committee will recommend to the President which locations should be designated as smoking­permitted, with the understanding that the provided weather shelters will be so designated.

Contingency policy

1. Smoking is prohibited in all locations on campus except within areas explicitly designated as smoking ­permitted.

2. Smokers shall dispose of the remnants of their smoking in appropriate receptacles.

3. Violations of this policy by students are grounds for initiation of the Honor Process, including informal and formal mediation. Egregious or repeated violations of this policy on the part of students will likely result in an Honor case. Violations of this policy by staff or faculty are grounds for initiation of appropriate grievance processes.
